Terms of service

1. Who we are and what this is

These terms govern the use of MailShogun, an SMTP relay and sending API for email delivery, provided by Julio Rodríguez Cruz. By creating an account you accept what follows. If you sign up on behalf of a company, you state that you are entitled to bind it.

2. What the service includes

  • Verification of sending domains with your own DKIM key and the three TXT records (DKIM, SPF and DMARC).
  • SMTP credentials per domain and API keys scoped by domain, permissions, IP and country.
  • Sending over SMTP (smtp.mailshogun.com:2525, STARTTLS), over the HTTP API and over MCP.
  • A sending log with per-recipient status and signed webhooks for delivery events.
  • Configurable sending limits and bounce and complaint control per domain.

You may use MailShogun for transactional email and for newsletters or campaigns sent to your own list. It is not a marketing platform: there is no template editor, list management, subscription management or unsubscribe tooling. You are responsible for ensuring that your list has the appropriate lawful basis and unsubscribe mechanisms.

3. Your account

You need a valid email address, your name and a password of at least eight characters. You are responsible for keeping your credentials safe and for the activity carried out with them; we recommend enabling the second factor. You must verify your email address to receive the operational notices of the service.

You may only send from domains you control and have verified by publishing the DNS records the panel gives you.

4. Acceptable use

MailShogun may not be used to:

  • Send unsolicited commercial email or use newsletters or campaigns with purchased, rented or harvested lists.
  • Impersonate people, brands or domains that are not yours, or forge message headers.
  • Distribute malware, fraud, phishing or unlawful content.
  • Circumvent sending limits, bounce thresholds or the security mechanisms of the service.
  • Systematically relay third-party email in a way that puts sending reputation outside your control.

You must act on bounces and complaints: do not send again to addresses that bounced permanently or to anyone who marked your email as spam.

5. Reputation, thresholds and suspension

We count bounces and complaints per domain. You can set your own threshold between 0.1% and 4%: cross it and sending for that domain is paused, resuming when the rate drops. At 5% the domain is suspended and reactivation requires a request with an explanation, which we review. If you accumulate three suspended domains, the whole account is blocked.

We may also suspend an account or a domain immediately in the event of a serious breach of the previous section or a clear risk to the deliverability of other customers. We will tell you by email.

6. Price and billing

  • You sign up for a monthly volume tier, in steps of 10,000 emails and up to 1,000,000, at €1 per 1,000 emails. The smallest tier is 10,000 emails, that is €10 a month.
  • The tier is paid up front and in full, whether or not you send its whole volume. On sign-up we charge the part proportional to the days left in the current month; after that, on the 1st of each month, the tier for the month ahead.
  • There is no free plan and no free trial.
  • Counted per email sent, including the test sends you fire from the panel.
  • The extra allowance is optional. You may choose €0, €5 or €10; at your account price it is converted into emails you may send above the tier. Without an extra allowance, the limit is the tier itself and the service stops accepting sends when it is reached.
  • Volume used within that allowance is settled at the end of the month, without rounding it up to blocks of 10,000 emails. We email you when you reach 80% of your tier.
  • Changing tier: moving up takes effect immediately and the part proportional to the days left in the month is charged; moving down takes effect on the 1st of the following month.
  • The monthly limit is the tier plus the selected extra allowance. You can also set daily, weekly and monthly limits per account and per domain.
  • Prices are stated without indirect taxes; those that apply are added to the invoice.

If a charge fails we will let you know so you can update the payment method. Prolonged non-payment may suspend sending until it is settled.

7. Availability

We work to keep the service continuously available and monitor the sending queue automatically, but we do not offer a service level agreement with a committed percentage. There may be maintenance windows and infrastructure provider incidents. Accepted messages are retried with increasing backoff before being marked failed.

8. Your data and your recipients' data

We do not read the content of the email you send: the message is held in the sending queue to deliver and retry it, and only its headers and delivery status are read. For your recipients' data we act as a processor and follow your instructions. The detail is in the privacy policy.

9. Liability

The service is provided as is, with professional diligence. We are not responsible for the content you send, for a third-party mail provider deciding to classify your messages as spam, or for indirect damages or loss of profit. To the extent the law allows it to be limited, our total liability is capped at the amount you paid for the service in the three months before the event giving rise to it.

10. Term, cancellation and changes

The tier runs month to month and there is no commitment beyond the current month: you can cancel whenever you want and no later month will be charged. The current month tier, already paid up front, is not refunded, and any excess you generated is invoiced at close. If we change these terms or the price we will email you with reasonable notice; if you disagree, you can cancel before the change takes effect.

11. Applicable law

Spanish law applies. For any dispute the parties submit to the courts of the owner's domicile, unless consumer protection rules establish a different venue.
